How agent fees work in Massachusetts

Commissions are “not set by law and are fully negotiable”: that’s the wording the National Association of Realtors now requires in every written buyer agreement. The fee goes into your listing agreement (selling) or buyer agreement (buying), so ask for it in writing before you sign either. (NAR, written buyer agreements)

Since August 17, 2024, agents who are Realtors need a written agreement with a buyer before touring a home with them. It must say what the buyer’s agent will be paid, and the agent can’t be paid more than that. A seller may still offer to pay the buyer’s agent, with the seller’s written approval, but the offer can’t be posted on the MLS. (NAR, written buyer agreements; NAR, what the settlement means for sellers)

At your first personal meeting about a specific home, a Massachusetts agent must give you the state’s Mandatory Licensee-Consumer Relationship Disclosure. It says whether they’ll act as the seller’s agent, the buyer’s agent or a facilitator, and explains designated and dual agency; dual agency needs your written consent. (254 CMR 3.00(13); Mass. agency disclosure form)
